A Mountain View man is behind bars after a physical altercation with two Stone County deputies during his arrest. According to Stone County Sheriff Lance Bonds, 27 year old Joshua Kirby is charged with two counts of second degree battery on law enforcement, resisting arrest, disorderly conduct and public intoxication. He is being held in the Stone County Detention Center on $20,000 bond.

The incident occurred Sunday night when a Stone County deputy responded to a verbal altercation between a man and a woman on Herpel Road near the Pine Hills Golf Course. When he arrived on the scene, the deputy observed the man swaying back and forth with slurred speech and blood shot eyes. When the asked by the deputy if he had been drinking, the man, Kirby, replied that he had.

The deputy asked Kirby to step back to his vehicle and Kirby refused with an obscenity. He then pulled away from the deputy when asked to place his hands on the patrol unit and a physical altercation began when the deputy attempted to place Kirby on the ground with Kirby striking the deputy three times and biting his right hand while growling like a dog.

The deputy asked nearby witnesses to call 9-1-1 for assistance and a second deputy arrived on the scene and attempted to taze Kirby with no effect. Although the first deputy was able to place Kirby in hand restraints, he continued fighting, kicking and screaming.

A third deputy arrived on the scene and observed Kirby head butting and kicking the first deputy. He then head butted the third deputy, resulting in the deputy’s lip splitting and bit him on the pants leg and left arm while again, growling like a dog.

The three law enforcement officers were finally able to place Kirby in the third deputies patrol car, where he continued fighting, kicking the third deputy in the throat, chest and leg.

Upon arrival at the jail, Kirby was placed in a restraint chair without further incident.

The deputies were treated for their injuries at the Stone County Medical Center and released.
