New investigation sought in fatal Arkansas police shooting

The family of a 67-year-old man fatally shot by an off-duty Little Rock police officer in 2010 wants a new investigation into the shooting.

The Arkansas Democrat-Gazette reports that attorney Michael Laux for the family of Eugene Ellison asked Prosecuting Attorney Larry Jegley for a new investigation after former Police Chief Stuart Thomas and an assistant chief said in sworn depositions that an autopsy report wasn’t adequately considered.

The report says two bullets struck Ellison in the chest at a downward angle while Officer Donna Lesher said Ellison was standing when she fired. Lesher and another off-duty officer were working as apartment complex security guards and Lesher said she fired when Ellison came at her while holding a cane like a baseball bat.

Both officers were previously cleared in the case.

Jegley declined comment.
