Man in wrong place at wrong time is arrested

Rex Foster of Viola found himself in the wrong place at the wrong time resulting in his arrest in early December last year.

Foster changed his plea to guilty of the drug-related charges filed against him as a result of his December encounter with law enforcement and was given five years probation in Baxter County Circuit Court Thursday.

Foster’s problems started when he picked a time to visit a person when law enforcement personnel were present to arrest the man living at the residence on drug and firearms charges.

The law enforcement personnel on scene saw the 50-year-old Foster pull into the address in a white pickup truck.

According to the probable cause affidavit, when officers attempted to make contact with Foster, he “ducked down behind the truck” and would not comply with instructions to come out from behind the vehicle.

When officers were able to make contact with him, Foster was found to have a glass-smoking pipe with narcotic residue. The pipe was of the type used to ingest methamphetamine.

A small plastic bag containing a crystalline substance was located hidden in a dented area of the truck. At the time of his arrest, Foster was on felony parole for various violations.
