Charge dismissed against felon who shot himself

A felony charge of possession of firearms by certain persons has been dropped against 50-year-old Donald Hurst of Yellville following an incident in 2017 when the Marion County man shot himself in the hand. The charge stemmed from Hurst being a convicted felon.

According to the probable cause affidavit, a Marion County Sheriff’s deputy was dispatched to North Arkansas Medical Center in Harrison in August 2017 where Hurst was being treated for the gunshot wound.

Hurst told the officer he was on his property with a .22 pistol when the weapon jammed. He said when he tried to unjam the pistol, it discharged shooting the palm of his left hand.

When the officer checked the databases of the state and national crime information centers, he learned Hurst was a felon.

Judge Gordon Webb’s nolle pros ordered was filed in Marion County Circuit Court Tuesday. The three-line order noted “from the statements of the parties and other matters now before the Court, the Court finds that the charges shall be Nolle Posed.” No other details were provided in the online court case record.
