Drug, weapons charges lead to probation sentence

A Marion County man, 29-year-old Kenneth Elder of Ralph, has been sentenced to six years of supervised probation on felony drug and weapons charges.

The sentence was handed down June 27th in Marion County Circuit Court following a negotiated plea. Elder was originally also charged with a felony count of simultaneous possession of drugs and firearms, three misdemeanors and three driving\vehicle violations. The plea agreement and statement were filed Tuesday.

According to the arrest affidavit, an Arkansas State Police trooper stopped the vehicle Elder was driving on State Highway 178 near Fairview in July 2017, after observing its broken taillight and windshield.

When Elder was unable to produce his driver’s license, he was asked to exit the vehicle. As the officer conducted a pat-down for weapons, he confirmed Elder’s identity and placed him under arrest for an outstanding warrant from the Mountain Home Police Department and for driving on a suspended license.

While searching Elder’s pockets, the officer found a clear plastic baggie containing what was believed to be marijuana, a container holding a white crystal substance believed to be methamphetamine, digital scales, and a clear glass pipe commonly used for smoking methamphetamine in his right cargo pocket.

With Elder placed in the back of the patrol car, the trooper initiated a search of his vehicle. The search produced a metal revolver with a wooden handle containing six bullets under the front passenger seat. A box containing 21 additional bullets was also located. A further search produced rolling papers in the front driver’s door.
