BC Airport Commission accepts settlement in lawsuit

The Baxter County Airport Commission has agreed to payment of a $90,000 settlement offer in a lawsuit the airport filed in Baxter County Circuit Court in 2015. The action came in the airport commission’s meeting Tuesday.

The suit stems from an agreement in 2010 between the airport commission and Aerial Surveys, Incorporated of Conway. Through the agreement, the airport commission began renting Aerial Surveys’ hangar for a two-year period for equipment storage, including payment of utilities, taxes, and insurance for the previous two years.

In 2013, when the airport commission had not been able to obtain the financing to acquire the hangar, Aerial Surveys entered into a lease with an aviation company.

A short while later, Baxter County Judge Mickey Pendergrass notified Aerial Surveys President Tim Tyler his company was in default for failure to pay rent since 2008.

Judge Pendergrass says Aerial Surveys maintained in the suit with the airport commission’s continued possession of the property, it lost the opportunity to lease its facility to the aviation company.

The airport commission’s approval of the settlement payment followed an executive session with Judge Pendergrass and Baxter County Attorney David Ethredge.

In other business, Dr. Kyle McAlister was nominated to serve on the commission to replace Greg Mills.

The commission agree to a lease of the restaurant space in the terminal building. The name of the new restaurant has not been determined. However, the owners have others restaurants in the area.
