Report of man with a gun in park leads to arrest

A report of a man with a gun in the woods at Hickey Park in Flippin has led to the arrest of a Marion County man, 28-year-old Justin Dayberry of Yellville.

According to the probable cause affidavit filed Tuesday, Flippin police officers responded to the call on the afternoon of September 5th from a city employee who reported having been approached by a man, later identified as Dayberry, who pulled the weapon on him while he was working on his inoperable four-wheeler.

The employee told officers he didn’t know the man who fled into the woods on foot saying he could not stay because he had warrants.

A search of the park revealed Dayberry sitting crouched behind a large brush pile. Dayberry raised his hands when ordered, but would drop one to his waist before returning it into the air after repeated instructions.

Dayberry told the officers there was a .22 caliber revolver on the ground he had found in the woods and was unloading.

In the area where Dayberry was crouched, officers observed the .22 revolver, the Yellville man’s identification car, one .22 round of ammunition, a set of pliers and a multi-tool. The firearm was loaded with five rounds and an empty chamber in the cylinder.

A check with the Arkansas Crime Information Center database indicated Dayberry is a convicted felon and an absconder, with an active parole violation warrant.

During a search of the subject, officers located a small amount of a green leafy substance consisted with marijuana and a metallic smoking device.

Dayberry was charged with the felony offense of possession of a firearm by certain persons, meaning he is a convicted felon, along with misdemeanor counts of possession of a Schedule VI controlled substance and possession of drug paraphernalia.

His bond was set at $5,000.
