Thomas Russell Hutson of Bull Shoals pled not guilty to charges of aggravated assault during a session of Baxter County Circuit Court Thursday.

According to court records, the 29-year-old Hutson was involved in a physical altercation at a Gassville residence early this year in which he allegedly fired a spear gun at 42-year-old Dwayne Douglas Munden.

Investigators say that Hutson accompanied Richard Lee Hamilton to the Munden residence to remove a third party from what Hamilton believed to be “an extremely dangerous” situation.

When the two arrived, a physical altercation erupted in which Hamilton allegedly attacked Munden with a large pipe and Hutson with the spear gun.

Ironically, Munden was jailed shortly after Hamilton and Hutson allegedly attacked him. Munden was charged for fighting with a Baxter County Deputy Sheriff. According to court records, the deputy had gone Munden’s residence as part of an on-going dispute centering on a common water well that serves Munden’s residence and that his daughter and son-in-law next door.

A significant number of protective/no contact orders have been sought by or filed against Munden related to the water well dispute and other matters.

When the deputy arrived, he attempted to arrest Munden for violating a no contact order then in force and Munden resisted to the point that it was necessary to use a stun gun and pepper spray to subdue him.

Additional deputies were called to the scene to assist.

A failure to appear warrant is currently outstanding on Hamilton who failed to show up for a court appearance on August 4th on charges stemming from the alleged attack against Munden.

His bonding company has until December 8th to either produce Hamilton or forfeit the $7,500 bond they wrote to ensure that Hamilton would make scheduled court appearances.
