(AP) – A lawsuit alleging violation of the Arkansas Freedom of
Information Act has been filed against the Fort Smith School Board.
The Arkansas Democrat-Gazette reports that the lawsuit was filed in Sebastian
County Circuit Court on Tuesday by attorney John McCutcheon on behalf of Fort
Smith resident June Bradshaw.
The lawsuit asks a judge to rule that emails board members circulated among
themselves from Oct. 8-14 involving the election of board officers constituted a
meeting for which no notice was given.
Board President Deanie Mehl says that she and other board members do not
believe they violated the Freedom of Information Act because the board took no
action on the election of officers until members were in public session and
because the emails were made part of the public record.
