3 felony charges, including rape, dropped in Marion County case

Three felony charges of rape, aggravated assault on a family/household member and false imprisonment have been dropped in a Marion County case.

Online court records indicate the state moved to nolle pros the charges against 27-year-old Eric Franklin Poslick in an order filed late last month by Circuit Judge Gordon Webb.

According to the order, the victim, identified as the defendant’s wife, is refusing to have any contact with the prosecutor’s office and has advised her mother she’s getting back with Poslick once he is released from custody. The judge’s order directed Poslick be released from the Marion County Detention Center.

The state reserves the right to refile the charges within one year, if the victim can be found, according to the order.

The charges stem from an incident last September occurring at a residence along a county road near Flippin.

The alleged altercation began inside a residence and moved outside, with a male juvenile present and attempting to intervene.
