Judge blocks drummer Joey Kramer from performing with Aerosmith at the Grammys

Tommaso Boddi/Getty Images for Janie’s FundAfter suing his four Aerosmith bandmates because they wouldn’t let him perform at the Grammys with them, a judge has rejected Joey Kramer‘s argument.

TMZ reports that a judge didn’t find Kramer’s defense convincing enough to let him rejoin Aerosmith for the band’s two performances: Saturday’s MusiCares Person of the Year gala, where the band will be honored, and Sunday’s Grammy performance.

“Given that Kramer has not played with the band in 6 months and the dearth of available rehearsal time before the upcoming performances, Kramer has not shown a realistic alternative course of action sufficient to protect the band’s business interests,” the judge ruled Wednesday.

TMZ also obtained footage of security guards acting upon the judge’s orders and turning Kramer away from Aerosmith’s Grammy rehearsal over the weekend.

According to Rolling Stone, Kramer’s lawsuit alleged Aerosmith’s other members unfairly asked him to audition to show his drumming was adequate before they’d allow him to play with them again.

In turn, the band issued a statement on Tuesday regarding the suit, saying, “Joey Kramer is our brother; his wellbeing is of paramount importance to us,” the statement begins. “However he has not been emotionally and physically able to perform with the band, by his own admission, for the last 6 months. We have missed him and have encouraged him to rejoin us to play many times but apparently he has not felt ready to do so.”

The message continued, “Joey has now waited until the last moment to accept our invitation, when we unfortunately have no time for necessary rehearsals during Grammys week.  We would be doing a disservice to him, to ourselves and to our fans to have him play without adequate time to prepare and rehearse.”

Aerosmith had invited Kramer to attend both performances, but as a guest.
