Transfer of sex-related crime case to juvenile court requested

A case of a 17-year-old charged with three counts of rape now filed in Stone County Circuit Court may be transferred to juvenile court. The Class Y felony is the most serious crime in Arkansas not punishable by death.

Online records indicate Tammy L. Harris, public defender for the 16th Judicial District, has requested the transfer since the male defendant was under 18 years of age at the time of the alleged offenses.

According to the probable cause affidavit, in a post-Miranda interview the teen suspect allegedly confessed to having sexual intercourse with the victim starting in 2018 and continuing until last month. However, the victim reportedly told an investigator with the Batesville Child Advocacy Center the offenses for which the teen is charged all occurred earlier this year. The victim is 11 years old.
