Stone County sex offender jailed after failing drug testing 7th time

A Stone County man, 62-year-old Tony D. Avey of Timbo, has been arrested after reporting to his parole officer and reportedly failing a drug test for marijuana use for the seventh time.

According to the probable cause affidavit, Avey reported to his parole officer in Mountain View on Aug. 12.

Avey is a Level 3 sex offender and is on parole, with a prior felony conviction for sexual assault and possession of a firearm by certain persons. He is also in the Sex Offender Aftercare Program, with special conditions and guidelines to follow.

He reportedly arrived at the Arkansas Community Correction’s office driving a vehicle not registered with his parole officer or sex offender coordinator.

Officers took Avey back to his residence, where they conducted a search.

They reportedly located a baggie with marijuana residue and a loaded .357 pistol under a sofa cushion where Avey was sitting.

They also located a rifle with 11 rounds in a 30-round magazine under the mattress of Avey’s bed. Two computers hooked to the television were disconnected.

A further search revealed a .380 caliber handgun on the other side of the mattress where Avey sleeps.

A few hours later, officers were alerted to Avey having a second residence a short distance from his home along Shelby Lane. Officers determined Avey had failed to register the second residence with his parole officer and sex offender coordinator.

When officers advised Avey of their intentions to search the second residence, he reportedly said, “There will be a gun or two in there,” Numerous loaded firearms were reportedly located in the residence.

Avey has been charged with felony counts of failure to comply with registration requirements for his vehicle and the second residence and possession of a firearm by certain persons, meaning he is a convicted felon. He was also charged as a habitual offender. Avey’s bond was set at $50,000.
