Father, son charged in fatal shooting despite not firing gun

SPRINGFIELD, Mo. (AP) – A father and son were charged Friday with murder after a man they were with was shot and killed by a resident at a Springfield apartment complex, police said.

Rick Johnson, 48, of Springfield, and Rick Johnson, 27, of Nixa were charged Friday with unlawful use of a weapon and second-degree murder in the June 17 death of Joshua Woods.

Prosecutors say the Johnsons and Woods were looking for people they thought had stolen from the elder Johnson. When Woods and the younger Johnson, who was armed, tried to break down an apartment door, a resident fired through the door, killing Woods.

The Johnsons were charged under Missouri’s felony murder rule, which allows charges if someone is killed during commission of a dangerous felony.

Online records indicate both Johnsons are in prison for unrelated cases, The Springfield News-Leader reported. They do not have attorneys for this case.
