Gassville man arrested on rape charges

A 20-year-old Gassville man was arrested Saturday after allegedly drugging and raping a juvenile.

Dustin Lee Brandenburg is being held in the Baxter County Detention Center on a $100,000 bond on a Class Y felony charge of rape and a Class C felony of introduction of a controlled substance into the body of another person. Class Y felonies are the most serious classification of crime in Arkansas not punishable by the death penalty.

According to the probable cause affidavit from the Gassville Police Department, authorities received a call reporting a disturbance at a Gassville residence. Authorities arrived and found the victim’s parent, who reported the juvenile was missing from their home. The parent said two juveniles had allegedly gone to Brandenburg’s residence to “watch movies.”

One of the juveniles was allegedly “sent home” by Brandenburg, leaving him alone with the other. The parent then went to Brandenburg’s residence, entered the home and allegedly found Brandenburg and the juvenile in a bedroom. The juvenile’s clothes were reportedly “disheveled” and the teen was “acting very out of it and lethargic.”

The juvenile was transported to Baxter Regional Medical Center, where a rape kit and a drug screen were conducted. The tests found evidence of the drug Xanax in the juvenile’s system.

Brandenburg alleges the juvenile took the drug willingly, but the teen reported Brandenburg had given the juvenile a glass of “special tea” that was “sour.”

The affidavit reports Brandenburg was issued his Miranda rights and allegedly admitted to sex with the juvenile and that he had taken the Xanax from a family member’s prescription bottle earlier in the day.
