Attorney says client can’t pay for food and shelter and needs cash bond arrangements changed

The attorney for a Mountain Home man says his client is having trouble paying for food and rent and asked the court to allow him to substitute a $15,000 cash bond with one that would be written by a bail bond company.

A bond written by a company only requires that 10 percent of the principal amount be paid when the bond is issued, along with certain other fees.

The motion was approved during a session of Baxter County Circuit Court Monday. The bond that will be posted by the bail/bond company will increase to $25,000. In addition, 52-year-old Brian Radcliff must be drug tested every Monday.

Radcliff was charged with pushing a man’s truck and trailer off the road stemming from a disagreement over the purchase of the trailer.

The victim said he had agreed to purchase the trailer from Radcliff but had not received the title and was withholding payment until the title was in his hands.

On April 6 last year, the victim said Radcliff and another male came to his residence along Cody Creek Drive and parked at the end of the driveway effectively blocking him from leaving the property and that Radcliff was shouting at him from the roadway.

The victim said when he attempted to go around Radcliff’s vehicle, Radcliff began “inching closer and closer.” Radcliff was alleged to have eventually rammed the victim’s truck and the attached trailer causing them to leave the road.

A female in the victim’s truck confirmed the sequence of events as did a man described as a “groundskeeper” for the victim.

The male in Radcliff’s truck told a different story. He said the victim had hit Radcliff’s truck.

Radcliff is charged with aggravated assault, criminal mischief and harassment.
