Two men admit to possessing drugs while in jail

Two men pled guilty in unrelated cases to possessing drugs while incarcerated in the Baxter County Detention Center and both were put on probation.28-year-old David Fiss of Briarcliff was given 10 years probation after admitting he had methamphetamine while a prisoner in the jail. The suspected drug was discovered in March when a member of the jail staff did a cell search of A-Pod where Fiss was confined.

As part of the search, Fiss was taken into the change-out room located in the booking area. As Fiss was taking off his right sock, a small plastic bag fell onto the floor near him. The jailer reported that Fiss attempted to cover the bag with his foot. According to the probable cause affidavit, the bag contained a small amount of a substance suspected to be methamphetamine.

In the other case, 29-year-old Joseph Paul Smith of Mountain Home pled guilty to having various prescription drugs in the jail while he was locked up in the facility. He had no prescriptions for the medicines.

Smith was given four years probation.

According to the probable cause affidavit in his case, a member of the jail staff reported observing what was termed “suspicious activity” inside a holding cell and went in to check on Smith and another inmate who were confined together.

During the check, the jailer located three pills hidden on Smith’s person wrapped in toilet paper. The drugs were identified as Alprazolam, Diazepam and Clonazepam — all schedule IV controlled substance.

At the time, Smith was reported to have been in jail since January 11th on other drug charges and a probation violation.
