Both Nothwehr’s wife and son were in court Thursday and 14th Judicial District Prosecuting Attorney David Ethredge told Judge Gordon Webb that the family members were in agreement with the sentence handed down in the case.
Nothwehr was charged with aggravated assault on a family member, endangering the welfare of a minor and carrying a prohibited weapon.
According to investigative records, the 40-year-old Nothwehr called his son Sepember 24th of last year and asked that the son pick him up since he had been drinking and his vehicle was equipped with an interlock device that would not allow it to be started if the person attempting to drive it had consumed alcohol.
The son reported that they drove to several locations and that, at one point, the son said his father had him stop at a liquor store. The son said the father had been drinking while in the vehicle.
The son told investigators that that his father was “griping about things” and that he told his father at one point “to quit being a cry baby”. Nothwehr is alleged to have pointed the pistol at his son’s head and held the gun in that position for some time as they continue driving.
Nothwehr was eventually taken into custody at a residence on Ramona Road and the firearm was also located at that address. Neither the 16-year-old, nor his 12-year-old brother who had been in the vehicle at one point were physically injured in the incident.
