Messick pleads no contest to battery in attack on female victim

Danny Ray Messick of Midway entered a no contest plea to reduced charges of second degree battery stemming from an attack on a victim who had confronted him to complain about some of her kittens that had been killed.

The 57-year-old Messick had originally been charged with aggravated assault. He entered his no contest plea during a session of Baxter County Circuit Court Thursday and was sentenced to two years probation.

According to the probable cause affidavit, a report was filed with the Baxter County Sheriff’s Office that outlined an incident that took place October 4th last year. In the report it was alleged the female victim had confronted Messick about the dead kittens and Messick became angry, grabbed her by the neck, shoved her up against a toolbox in a shed while continuing to choke her.

She alleged Messick was squeezing her neck so hard she was unable to breath or call for help. She said she was finally able to break Messick’s grip to the point that she was able to call for help.

The victim’s husband came to his wife’s assistance after he heard her call out and tackled Messick knocking him to the ground.

Investigators reported there were marks on the woman’s neck.

Messick was ordered to have no contact with the victim or her family once he is released from jail.
