Doctor’s lawsuit and hospital’s counterclaim dismissed

A lawsuit filed against North Arkansas Regional Medical Center by Dr. Marcus Causey has been officially dismissed.

According to the Harrison Daily Times, Causey filed for an injunction against NARMC in January to restore his hospital privileges, which were suspended in December. He claimed his privileges were suspended because he worked for Washington Regional Medical Center instead of NARMC.

The hospital claimed the doctor’’s privileges were suspended based on the credentials committee’s findings that ” “Causey’’s practice was (1) detrimental to patient’s’ safety or the delivery of appropriate patient care in the hospital (2) lower than the standard and airs of the Medical Staff or qualifications, obligations or responsibilities of practitioners and (3) disruptive to the operations of the hospital.””

NARMC even filed a counterclaim alleging Causey breached a confidentiality agreement by filing for the injunction using information from the credential committee’’s findings. But Causey answered the allegation by stating Arkansas law allowed him to disclose any materials necessary for his defense. Causey also alleged hospital CEO Vince Leist appeared to have breached the agreement in a presentation to the Harrison Lions Club in February.

Causey issued a statement stating the hospital had reinstated his privileges, but there were still issues to work out before he began seeing patients at the hospital again. Causey’s legal action was filed in Searcy County Circuit Court because law allowed him to file the appeal in any county adjoining Boone. Records show an order was filemarked around 3:00 Friday afternoon, dismissing both Causey’s complaint and the hospital’s counterclaim on a joint motion of the parties.

The order is a dismissal without prejudice, meaning it could be filed again within a year.
