2 appear in court for failure to register as sex offenders

Two men charged with failure to comply with sex offender registration requirements were in Marion County Circuit Court Wednesday.

A Midway man, 33-year-old William Dillingham, entered a not guilty plea before Judge Gordon Webb.

According to the probable cause affidavit, Dillingham came to the Marion County Sheriff’s Office on March 28th to change his registration from Baxter to Marion County. He said he was going to live at 236 Hugh Lane in Oakland and was advised to get his driver’s license switched to match his new address.

On May 9th, the Marion County Sheriff’s Office received a copy of his current driver’s license indicating he was living at the Hugh Lane address. A check with the Arkansas Crime Information Center database revealed Dillingham’s address to be 313 Duckworth Drive in Midway.

A check with the Baxter County Sheriff’s Office revealed Dillingham is residing in this county and had stayed at the Marion County address for less than a week. Baxter County authorities were advised Dillingham did not report his move from Marion County.

In the second case, 38-year-old Steven Schwartz of Pyatt made his second appearance in Marion County Circuit Court. Schwartz had entered a not guilty plea in late May to the charge of failure to comply with sex offender reporting requirements. Judge Webb directed the Marion County man to appear for pretrial August 29th.

Schwartz’s charge follows a Marion County Sheriff’s deputy attempting to conduct a home visit in early May. It was the first of what would be three attempts in one week to conduct a home visit. Each time the deputy left a card in the door of the residence with a note for Schwartz to contact him.

After the third visit, Schwartz called the sheriff’s office. He told the officer he leaves for work between 6:00 and 6:30 in the mornings to arrive at his out-of-town destinations ranging from Oakland to Promise Land to Harrison and Eureka Springs.

The officer noted Schwartz had not reported a change in his employment, noting when the Marion County man re-verified in February, he was unemployed.
