
A Marion County man is accused of breaking into his ex-wife’s residence last week and removing a safe from the property. According to the Marion County Sheriff’s Office, 44-year-old Garry Gebhart has been in the Marion County Detention Center since Wednesday on multiple charges.
A deputy was dispatched to the residence on Toll Point Lane July 23rd for a complaint on theft and a violation of a protection order. When he arrived, the victim stated she was out-of-state, and a pair of ex-spouses were house sitting for her. When she returned home, she reviewed her home camera system and observed her ex-husband, identified as Gebhart, entering her residence on the morning of July 19th. She alleges she observed Gebhart carrying a light-colored fire-proof safe through the front door and placed it on a plastic chair on the front deck. The victim says she then watched Gebhart unplug the camera, and she wasn’t able to observe anything else related to the incident.
The victim alleges personal documents, birth certificates, shot records, diplomas, military records, property papers, two antique two-person cross cut saws, a jewelry wedding ring set with rubies and diamonds, a gold necklace with a Jesus anchor and a .22 caliber single-shot rifle with a .410 gauge interchangeable barrel were stolen from her residence in addition to the safe. The deputy says in an arrest affidavit he observed Gebhart exiting the residence on the home security system with what appeared to be a light-colored safe and placing it in a white chair on the front deck. Dispatch advised the deputy Gebhart and the victim still have a valid protection order on file.
Gebhart was interviewed by a sheriff’s criminal investigator at the office the next morning. He reportedly stated Post Miranda he entered his ex-wife’s residence and took filing boxes with paper work, a safe, papers and the saw, but he did not take the firearm. Gebhart then said he placed the items he removed from the residence in a storage building, and he’ll give them back when his ex-wife returns his belongings.
Gebhart also reportedly stated he observed animal mounts, pictures and other items of his missing from the residence after he entered the structure. He also said a female staying at the residence let him enter, but he also stated he was aware of the protection order. Gebhart added he didn’t know the female, and that was the first time he had seen her. He declined when asked if he would like to make a written statement.
Gebhart was booked on felony counts of residential burglary, breaking or entering and theft and misdemeanor counts of violation of a protection order and criminal trespass. His bond was set at $25,000, and he is scheduled to appear in Marion County Circuit Court.
