Wayne Mathis Smith

Michael Anthony Behrens

What began with one man targeted in a drug investigation has led to four felony counts against three individuals.

According to the probable cause affidavits released Tuesday, on Monday investigators from the 14th Judicial District Drug Task Force, with the aid of a confidential informant, purchased methamphetamine from three Baxter County residents.

The CI met with 65-year-old Wayne Smith and 24-year-old Ashley Marie Coniglo, both of Gassville, and 28-year-old Michael Behrens of Mountain Home. Behrens was the original target of the investigation; however, all three individuals allegedly actively took part during the monitored and recorded drug transaction.

After the transaction was complete, officers met with the CI where a baggie containing approximately 7 grams of methamphetamine was relinquished.

Shortly afterward, the vehicle used during the transaction was stopped. All three subjects were taken into custody and the vehicle seized. An inventory of the vehicle was conducted, and numerous small plastic baggies, commonly used for packaging and dispensing methamphetamine, were found. These baggies were found in close proximity with other drug paraphernalia in a bag believed to be owned by Coniglio. Also found in Smith’s pants pocket were two syringes believed to be used for injecting methamphetamine. There were additional syringes found inside the vehicle.

A cellular telephone was used to orchestrate the drug deal.

The three are charged with felony counts of delivery of methamphetamine, unlawful use of a communication device, possession of drug paraphernalia used for delivery of methamphetamine and possession of drug paraphernalia or syringes.

Bonds for the three were set at $20,000 each.
