A man seeking employment with the Marion County Sheriff’s Office has been charged with the felony offense of failure to register as a sex offender or report an address change.

According to the probable cause affidavit filed Tuesday, 61-year-old Brian Phifer of Yellville provided a Marion County address when he applied for employment. However, a deputy was unable to locate Phifer.

The officer placed a call to Denton County, Texas where Phifer was registered as a sex offender. A sex registry officer advised Phifer had mentioned he was going to move, but he didn’t say when.

The following day, the deputy spoke with Phifer who advised he had been living in Marion County for about a week. He told the deputy he had to return to Texas to close on his house and would return to Marion County in a couple of days.

The Arkansas Crime Information Center advised the deputy out-of-state sex offenders have seven days to register in Arkansas.

Phifer’s bond was set at $2,500.
