A Marion County man, 74-year-old Lee Roy Cagle of Peel, made his initial appearance in circuit court Monday on felony counts of terroristic threatening and aggravated assault, following a dispute with his neighbor in which shotgun pellets reportedly struck the man’s truck.

Cagle’s neighbor, who was reportedly visibly upset when talking with law enforcement in late August, said the two men had had multiple problems. He said they had been friends at one time, but things had gone too far.

The man said he loaded his dogs in the back of his pickup truck and drove them down to the lake to play. When he arrived, Cagle was there in his side-by-side and gestured to him in an inappropriate manner, before leaving.

The neighbor said he was on his way home after dark, when he noticed a side-by-side coming toward him. He reportedly told law enforcement he moved his vehicle to the edge of the road and dimmed his lights to allow the vehicle to pass.

When the side-by-side pulled up next to his vehicle, he noticed Cagle was allegedly the driver and pointed a shotgun at him while saying, “I’m going to kill you.”

The victim said he turned on the lights of his vehicle, sped away and heard two gun shots.

The man said when he arrived home and walked to the rear of his vehicle to let his dogs out, he noticed damage to the tailgate from shotgun pellets.

A sheriff’s deputy and an investigator traveled a short distance to Cagle’s residence. As the deputy was making his way to the front door of Cagle’s residence, the Summit man opened the door and stood on the steps of the home.

Cagle allegedly told the officers what had taken place that evening was part of a long story and referenced previous problems already documented by the Marion County Sheriff’s Office.

Repeated attempts to gather further details allegedly led to Cagle telling law enforcement he had nothing further to say, and he was taken into custody.

His bond was set at $25,000.
