Man violates probation, gets prison time

A man put on seven years probation for assaulting a woman causing serious injuries, was back in Baxter County Circuit Court Thursday facing the revocation of that suspended sentence.

The sentence was revoked after 31-year-old Austin Daniel Hamby admitted he had violated the terms and conditions of his probation. He was given two years in prison.

In late February 2017, a Cotter police officer was called to Baxter Regional Medical Center to speak to the victim of the attack.

She said her boyfriend, identified as Hamby, had kicked her in the midsection and hit her in the back with his fists while she was carrying her then six-month-old daughter.

The woman’s injuries required emergency reconstructive surgery, according to the probable cause affidavit.

In February of 2018, Hamby pled guilty to the charges against him stemming from the altercation and was put on supervised probation.

In a petition to revoke his suspended sentence filed in mid-March, Hamby was alleged to have violated a number of the terms and conditions of his probation.

Those infractions include, being charged with theft of property and criminal trespass in January, not reporting for a scheduled office visit, staying away from his registered address and being behind in paying fines, fees and court costs.

In addition, he is alleged never to have made a payment on restitution of almost $12,800 owned to Baxter Regional Medical Center for charges related to the victim’s treatment.
