
A 28-year-old Midway man, who screamed obscenities and fought with deputies at the court complex on May 20, will be facing new charges in connection with the incident, including second-degree battery on a police officer and impairing the operation of a vital public facility – both felonies – and disorderly conduct, a misdemeanor,
Tyler Cole Hutton, who has an open criminal case in which he is charged with domestic battery, was brought to the court complex from the county jail to deal with that case when the disturbance broke out.
According to a report of the incident, Hutton was brought into the court complex where he spoke to his attorney in a holding area located behind the courtroom where a session of Baxter County Circuit Court was underway.
After the attorney walked away, Hutton was reported to have begun “yelling obscenities and causing a general disturbance,” according to an incident report.
There were more than a dozen other inmates in the area along with Baxter County sheriff’s deputies.
Because of his unruly behavior, it was decided to return Hutton to the jail in a deputy’s patrol car.
Before he could be secured in the vehicle, Hutton was reported to have resumed “shouting vulgarities.”
As Hutton continued to resist being put in the patrol car, another deputy came to assist. A brief struggle ensued, causing the two deputies and Hutton to fall to the ground.
Hutton stopped struggling long enough for the deputies to get him back on his feet. He then began to fight again.
When the deputies threatened to use a stun gun on Hutton he stopped struggling and was secured inside the vehicle.
One of the deputies reported injuries to his thumb and wrist and sought medical attention.
Hutton was taken to Baxter Regional Hospital for treatment of an injury he received when banging his head on the “cage,” a metal device installed to seperate the back and front seats of a patrol car.
In his current criminal case, Hutton is charged with domestic battery for attacking a female acquaintance. The couple is reported to have a 10-year-old child together.
The newest domestic battery charge resulted in the filing of a petition on Jan. 7 seeking to revoke his 72-month probation in a 2018 case, also involving a fight with a girlfriend.
On Jan. 5, Hutton was reported to have been visiting with the victim in the newest case and the 10-year-old child they have together when an argument broke out.
According to the probable cause affidavit, Hutton and the victim were in her bedroom when problems developed.
During the argument, Hutton is alleged to have choked the victim. She was able to free herself briefly, but Hutton reportedly grabbed her hair, threw her back on the bed and began to choke her again.
At one point, the couple’s child entered the room and Hutton was said to have stopped the attack. The victim was able to run into the kitchen and grab a knife.
Hutton barricaded himself in the bedroom.
There were three other children in the house at the time, according to the incident report.
The victim is alleged to have gotten into an altercation with one of the other children.
The probable cause affidavit does not provide information on what sparked the encounter or what relationship, if any, existed between the three other children at the residence.
At that point, Hutton was reported to have come out of the bedroom and hit the victim with a metal baseball bat.
In the 2018 case, Hutton was accused of choking the victim and shoving his fingers into her eyes. He is also reported to have been in trouble for domestic violence in California, according to the Baxter County Sheriff’s Office.
Hutton was a no show for a circuit court appearance in his new case on Jan. 28. He was apprehended and surrendered to the county jail by his bail bond company Apr. 19.
His bond is shown as $25,000 on the county jail inmate log.
