A Fulton County man who was shot after allegedly engaging in a Christmas Eve gun battle with his son faces a slate of felony charges, according to court documents filed Wednesday.
Fifty-two-year-old Richard Garcia Sr. is charged with aggravated assault and five counts of being a felon in possession of a firearm, with bond set at $100,000.
According to the probable cause affidavit, authorities received a report of a man being treated for multiple gunshot wounds at the Fulton County Hospital on Christmas Eve of 2020.
A joint investigation involving the Fulton County Sheriff’s Office and the Arkansas State Police revealed Garcia allegedly assaulted his son with a hand gun and shot in his direction in the home. The son grabbed another handgun from his room and returned fire, hitting Garcia several times.
Investigators ruled the son fired in self defense to protect himself and other family members and will not face charges. A background check of Garcia showed he was a convicted felon and authorities located five weapons in the home, leading to the five counts of felon in possession of a firearm.
