Mountain Home man faces multiple felony charges for theft of fuel; six counts of computer fraud

A Mountain Home man is facing multiple felony charges after a report was filed with the Baxter County Sheriff’s Office for alleged theft of fuel and profit by a Commissioned Agent of Magness Oil Company.According to the probable cause affidavit, 52-year-old Brian Weidrick is accused of the theft of fuel and profits in the amount of $148,954. The complaint states Weidrick allegedly used Magness Transportation Company to load, haul and deliver the fuel in question.In July 2022, the owners of Magness Oil Company and Tri Star Energy based out of Nashville, TN, began negotiations of the sale of Magness Oil Company. In the same month, Weidrick provided forms establishing a new account with Magness Oil Company under Midwest Fuel and Freight LLC.

During the investigation, the new account forms were checked for verification with the address to be non-existent, and multiple attempts to contact someone with the number provided were unsuccessful. The social security number provided on the application was found to belong to a deceased female who died in 2007. On the form, investigators noted a question asked how long they had been in business answered with “2 years.” Based on information available from the Arkansas Secretary of State, Midwest Freight and Fuel LLC did not exist. In addition, financial information was provided as Simmons Bank with a contact name who did not exist. A subpoena from the prosecutor’s office showed no accounts or documentation to support the application.

Midwest Fuel and Freight LLC had multiple orders and deliveries of fuel from Magness Oil Company since August 2022 and was initiated through Magness Transportation Company in Gassville.

In October 2022, documents showed Weidrick applied for an LLC with the Arkansas Secretary of State’s Office with the company name Midwest Fuel and Freight LLC with his home address. Weidrick was listed as the Incorporator and Organizer of the company. The IRS Employer Identification Number listed on the paperwork was the same as provided in July 2022 on the consignment agreement application with Magness Oil.

Once the sale of Magness Oil Company was finalized in January 2023, the accounts from Midwest Fuel and Freight LLC were not part of the initial setup information Tri Star Energy received from Magness Oil. Once received, it was discovered ten fuel deliveries were completed for Midwest Fuel and Freight in the amount of $148,954.63.

Weidrick is facing multiple felony charges including one count of theft of property over $25,000, one count of theft of property over $5,000, two counts of theft of property over $1,000, six counts of computer fraud, one count of financial identity fraud and two misdemeanor counts of theft of property under $1,000 with an enhancement of the habitual offender act. He was booked and released from the Baxter County Detention Center on a $200,000 bond. He is scheduled to appear in court on January 22.
