Boone County man makes first court appearance for shooting another man in November

A Boone County man made his first court appearance last week for shooting another man in November. Thirty-nine-year-old Cody Ross Tate of Omaha is facing a felony charge of first degree battery for the incident.According to the probable cause affidavit, the victim went to Tate’s residence where they got into an argument. Tate provided deputies video from his surveillance system, but it did not have audio. The victim’s wife recorded part of the incident with her phone.

In the affidavit, it was noted Tate was the aggressor and was upset about the victim putting his name on paperwork. As the argument escalates, Tate pulls a gun and threatens the victim. He then hits him in the head with a wooden club several times.

The victim’s wife gets him to the truck, but he then walks to the front of the truck with his hands in the position of holding a gun. That is when Tate shoots him twice, including in the stomach, and the victim falls to the ground. Another man who was at Tate’s residence, and the victim’s son, help load him into the truck. The victim’s wife drives away and calls 911.

An ambulance meets the truck to render aid and the victim was airlifted to Cox South Medical Center in Springfield for treatment of his injuries.

Tate was arrested that night. He is free after posting $50,000 bond.
