A man currently charged in Baxter County with numerous felonies stemming from an incident in 2018 has a pending motion asking that his case be dismissed based on a claimed violation of his right to a speedy trial.
Thirty-two-year-old Christopher Alan Everett, who lists a Little Rock address, faces 13 counts of breaking or entering, 18 counts of theft of property, six counts of criminal mischief and two counts of commercial burglary.
There were 13 separate victims in the Baxter County case, with restitution estimated at almost $21,000, according to the probable cause affidavit.
He was in jail or prison for much of the period following the incident in Baxter County where his charges stem from break-ins and thefts in late September 2018.
Because of his incarceration, the warrant issued in the Baxter County case was not served until late last month.
When arrested in Batesville September 26, 2018, Everett was in the truck reported stolen from Gassville.
He was sentenced to 10 years in prison in Independence County Circuit Court and incarcerated in the North Central Unit of the state prison system at Calico Rock.
Everett acting as his own attorney – is a prolific filer of lawsuits. He has filed suits against a jail in another county, the state prison system and a whole host of employees who work in those detention facilities.
He has alleged incidents in which he was beaten, refused medical treatment, kept in isolation for long periods and forced into taking a guilty plea.
Everett also claims, that his mental problems were not being properly addressed.
Everetts suits have been considered in circuit courts, federal district courts, the 8th Circuit Court of Appeals and the Arkansas Supreme Court.
They have generally been found without merit.
He has filed paperwork alleging a violation of his right to a speedy trial in the Baxter County case, but no ruling has been made on the petition.
According to the probable cause affidavit in the Baxter County case, the owners of two businesses co-located in the same building in Gassville reported property being stolen, including a 1985 Honda 650 motorcycle.
Gassville police located the motorcycle. The rider told investigators he had been paid by a man he knew only as “Lucky” to take the motorcycle to a designated location.
The man said he did so, but that “Lucky” was a no show, so he rode the bike back to Mountain Home.
Surveillance cameras at a Mountain Home gas station showed Everett meeting the man and apparently arranging the transaction to get the bike to another location.
The name “Lucky” is apparently appealing to Everett. He filed a motion in Izard County Circuit Court while in prison at Calico Rock to change his name to “Lucky Phoenix Kloud.”
In his petition, Everett wrote that his name change was based on religious belief.
During the 2018 robbery in Gassville, suspects were reported to have located a lock box with the keys to every car on the lot of one of the businesses – Auto Worx.
All of the vehicles were gone through. A 2010 Ford pickup belonging to Sanders Auto Sales was stolen, according to investigators. It was this truck Everett was in when arrested in Batesville.
It was during his time in prison that he began to file lawsuits in an attempt to have his sentence in the Independence County case overturned for various reasons.
