A Norfork woman who pled guilty in August to renting a vehicle from a local business and not returning it as specified in the rental agreement has been ordered to pay almost $4,100 in victim restitution.
The woman was to have the car for two days, but the owner did not recover it until 512 days after the rental agreement was signed.
During a session of Baxter County Circuit Court Monday, the amount of restitution was established and a judgment was entered.
When thirty-nine-year-old Amy Marie Malaczewski entered her guilty plea to a theft of property charge, the amount of money she owed the victim had not been determined.
VEHICLE RECOVERED
The car’s owner eventually recovered the vehicle in St. Louis, according to court records.
According to the probable cause affidavit, Malaczewski is alleged to have rented a 2016 Nissan Altima on September 8,2021 with a return scheduled two days later.
According to the probable cause affidavit, the return date came and went with no sign of the vehicle or Malaczewski.
The victim contacted Malaczewski and was told she was in St. Louis but would soon be headed back to Mountain Home.
An investigator from the Baxter County Sheriff’s office reported that the victim began calling Malaczewski daily but received a multitude of different stories as to when the car would be returned.
On September 14, 2021, the victim filed a report on the missing vehicle and indicated it had an estimated value of $17,500.
Malaczewski was sentenced to five years probation during her court appearance in late August.
