Bermingham gets probation

Joshua Shane Bermingham of Gassville pled guilty to a number of charges stemming from an alcohol-fueled altercation that took place at a residence in Gassville in mid-December last year and was sentenced to three years probation and five months in the Baxter County jail with credit for time served.

The 39-year-old Bermingham was arrested after a Baxter County Deputy Sheriff was dispatched to a residence along Dupont Lane in Gassville to investigate a disturbance call.

The deputy reported that when he arrived on the scene, he found the front door to the residence partly open. The deputy said he could see broken glass and a coat rack on the floor.

After pushing the door further ajar, the deputy reported that he saw a male — later identified as Danny Haley — laying on the floor in a pool of blood and requested that an ambulance be dispatched to the scene.

According to the deputy’s report, Haley had several cut marks on his hands, face and head. His face and both hands were reported covered with blood. The deputy said Haley appeared to be “very intoxicated” and did not know what happened to him. He asked the deputy several times why his hands were bleeding.

A female came to the scene and reported that Haley and Bermingham had been dropped off at Highway 126 and Dupont Lane and both had walked to the residence. The woman said she was in the residence and let the pair in. She said Bermingham pushed Haley into the house and began to strike him “with anything he could get his hands on,” including a chair, lamp and vacuum cleaner. The woman said Bermingham threatened to kill everyone in the house.

The woman said she attempted to call 911 but Bermingham grabbed the phone and broke it. The woman fled the residence and made the call from a neighbor’s house.

Bermingham was found passed out behind the house. Deputies reported they had to hold him up to walk him to the patrol car. The deputy said Bermingham had no marks on his hands, but had dried blood on his hands and some on his pants.

The woman said Bermingham had lived in the residence at one time.
