The former assistant band director for Harrison High School, 30-year-old Kyle Smith, now faces state charges related to a previous federal conviction of sexual relations with a minor.According to Hometown Daily News, Smith is currently incarcerated without bond in the Taney County Jail, awaiting his next court hearing on January 18th.
Last November a federal judge in Fort Smith sentenced Smith to 15 years in federal prison for transportation of a minor with intent to engage in criminal sexual activity, and coercion and enticement of a minor.
In August of 2015, Harrison Police began investigating a report Smith was engaging in a sexual relationship with an underage student. The student disclosed Smith had invited her to his home in Branson to engage in sex.
The resulting investigation revealed Smith was also engaging in sexual activity with a second female student. According to federal prosecutors, Homeland Security Investigations recovered hundreds of messages and images containing overt sexual content shared between Smith and the juvenile females.
Smith appeared in court for arraignment on December 7th, and pleaded not guilty before Taney County Circuit Judge Tony Williams to four felony counts of statutory sodomy and four counts of statutory rape.
