Man arrested for selling equipment he hadn’t paid for

A man is behind bars after he allegedly sold a Caterpillar excavator he had bought and quit making payments on to another person. Thirty-nine-year-old Christopher W. Rhoades of Nixa, Missouri was arrested Thursday in Fulton County.

The probable cause affidavit in the case indicates Rhoades entered into an agreement in Baxter County in November to sell the excavator to an individual for $32,800. The victim stated he saw the equipment on Craig’s List and contacted Rhoades. The victim asked if the equipment had a lien on it, and Rhoades told him it was paid for and he was selling it to buy another piece of equipment.

In March, the victim was contacted by a repossession company who had tracked the excavator to his residence with a GPS on the equipment.

The victim contacted his attorney, and it was learned Rhoades owed over $36,250 on the excavator. The last valid payment was made in September of last year. Since then, Rhoades had made two payments with insufficient funds checks.

Rhoades is charged with felony counts of defrauding a secured creditor and theft of property. He is being held on a $32,000 bond.
