A Marion County man, 37-year-old Keith Richard Smith of Pyatt, has been sentenced to one year of supervised probation following an assault of a Flippin woman last December.

Smith’s sentence was handed down June 28th in Marion County Circuit Court following a negotiated plea to a lesser charge of misdemeanor domestic battery. He was originally charged with a felony count of aggravated assault on a family or household member. The sentencing order was filed Monday.

According to the probable cause affidavit, law enforcement responded to a fight in progress at a residence along North Berry Street in Flippin.

The first officer on the scene found a female standing in the driveway with her young son as she continued to yell at someone in the residence. As the officer began talking with the female, Smith exited the residence.

Upon examination, the officer noticed the female had dried blood around her mouth and some redness on her face, as well as a shade of red around her neck. She told the officer Smith had slapped her three times and choked her.

Officers noted Smith smelled of intoxicants and allegedly told them he had been consuming alcohol.
