Mtn. Home schools respond to recent lawsuit

     Mountain Home Schools Superintendent Dr. Jake Long issued a public response in connection with a lawsuit recently filed against the school district on behalf of a former student. In a response received by KTLO, Classic Hits and The Boot News Monday afternoon, Long says the district was surprised by the lawsuit and take exception to both the allegations and claims of liability. He says unfortunately a public response to individual student educational and disciplinary matters beyond what has been filed in court can not be made. However, he says, the district feels secure in the actions it has taken and will defend itself against the suit.
     The lawsuit, filed February 12 in the Western District of Arkansas Harrison Division of the United States District Court was made by Maumelle Attorney Theresa L. Caldwell on behalf of the parent and their child. The lawsuit alleges the student was denied educational opportunities in violation of Title IX, which guarantees equal protection of the laws under the Fourteenth Amendment to the U. S. Constitution.
     A formal response on behalf of the school district was filed in the Western District on February 27th by the Rogers office of Friday, Eldridge and Clark.
     A case management hearing has been set for April 11th at 1:30 p.m. In the fifth floor courtroom of the John Paul Hammerschmidt Federal Building in Fayetteville. A number of issues are set for discussion during the hearing, including the setting of a trial date for the case.
