Charges against McClain dropped, victim has no objection

Charges against 47-year-old Kirk Hubbard McClain of Mountain Home stemming from a series of events — including attacks on a man at a local restaurant — have been dismissed with no objection from the victim, according to court records.

McClain had been charged with leaving the scene of an accident involving property damage and criminal mischief.

According to the probable cause affidavit, the events leading to the charges occurred Nov. 18 and 19 last year.

About 7 p.m., on Nov. 18, McClain was alleged to have started an argument with a man in a local restaurant. He was reported to have physically attacked the man, and the victim struck McClain in the mouth. McClain was reported to have attacked the man again only a few minutes later and restaurant staff restrained him and removed him from the building.

At 3:30 a.m., Nov. 19, a truck alleged to have been driven by McClain arrived at a residence along Turnberry Court. The truck was used to push a 2017 Jeep through closed garage doors. The vehicle also struck the brick exterior of the home causing additional damage.

A security camera at the Turnberry Court residence recorded the incident. McClain’s truck was described as unique — being equipped with a lift kit, large wheels and a custom front bumper — and easy to spot on images captured by the camera

Total damage to the Jeep and the residence was estimated between $10,000 and $20,000.

In a letter to 14th Judicial District Prosecutor David Ethredge, the victim reported arrangements had been made to compensate him for damage done by McClain. He told the prosecutor he was “very satisfied with the end result.” The court ordered McClain to have no contact with the victim for 12 months.

At 4:40 a.m., Nov. 19, McClain’s truck was reported to have been found approximately 200 yards from his residence. The engine was still warm and the vehicle’s front bumper was damaged. Concrete and/or mortar dust was visible on the truck.

In reports concerning the events, police noted McClain appeared to be under the influence of alcohol or some other substance.

He was arrested Nov. 20, booked into the Baxter County jail about 7:50 p.m. and released on $10,000 bond about a half-hour later.

McClain’s attorney entered a not guilty plea to the charges against his client in mid-December last year.
