A 38-year-old Mountain Home man released from the Baxter County Detention Center just over four hours earlier, found himself back in jail on felony charges after an incident with a gun May 22 at a local apartment complex.

Jimmy D. Johnson faces charges Class D felony charges for aggravated assault and endangering a minor, along with a misdemeanor charge of public intoxication.

The Mountain Home Police Department (MHPD) received a call shortly after 2 p.m. of an intoxicated male with a gun. Two officers arrived on scene and located a man, later identified as Johnson, sitting on his second story balcony yelling at a female.

The woman told officers “the gun was on the ground”, with a pistol located between cars. The officers cleared the weapon and found an “almost full” magazine and a bullet in the chamber.

According to electronic jail records, Johnson had been released at 10:09 that morning from the detention center on an unrelated disorderly conduct charge. When officers encountered Johnson, they found him to be extremely intoxicated, surrounded by small, empty whiskey bottles and a gun case.

The victim told officers she tried to leave her apartment with her child because Johnson was “waving” around a pistol. The woman told officers she told Johnson to put the gun away, but he refused. She then grabbed the pistol from Johnson’s hand and tossed it to the grass below.

As the woman continued to the parking lot, Johnson allegedly began tossing empty whiskey bottles at her and her child.

Johnson allegedly told authorities “it was not illegal for him to have a gun” as the officers located a gun case with a serial number matching the weapon recovered from the parking lot. After being taken into custody, Johnson’s preliminary breath test indicated a blood alcohol level of .27, more than three times the legal limit.

Johnson was released from the Baxter County Detention Center on a $5,000 bond last Saturday night.
