Repeat drug offender jailed on no bond hold set for court this week

A Salem man, 34-year-old Robert Lynn Stigall, jailed on a no bond hold is set to appear in Fulton County Circuit Court this week.

According to the probable cause affidavit, the Fulton County man and a female were arrested last month following a report of shots being fired at individuals as they passed Stigall’s residence along Republican Road.

According to the victims’ statement, they were chased down the road by an individual shooting at them several times with a handgun.

The victims identified a picture of a car involved in a drug arrest a couple of weeks prior to the alleged shooting incident. The vehicle had been driven by Stigall, who was accompanied by a woman identified as his girlfriend, 41-year-old Misti Herndon. The victims also identified Stigall as the individual reportedly firing the shots at them.

Stigall is on active supervision with a search waiver on file.

Officers conducted a home visit at Stigall’s residence, but he was not present. Herndon’s son allowed officers into the residence, where they reported seeing several drug-related items in plain view. A more intensive search of the home revealed additional drug paraphernalia and a loaded pistol.

Herndon returned and said Stigall was with a friend who was moving. She allegedly told officers regarding the shooting incident they had seen someone rummaging around an old house on the property. She said Stigall chased the individuals down the road. But she said the individuals shot at Stigall. In a post Miranda interview, Herndon is alleged to have changed her story, saying she was in a vehicle with Stigall when he fired at the individuals.

Officers went to the friend’s house where Stigall was reported to be. However, they were unable to locate Stigall and found a female hiding in the nearby woods.

Stigall and Herndon are charged with two felony counts of a terroristic act and aggravated assault, along with single counts of maintaining a drug premises, possession with the purpose to deliver a Schedule VI controlled substance and possession of drug paraphernalia with the purpose to analyze methamphetamine. Stigall also faces a felony count of being a felon in possession of a firearm and being a habitual offender.

Herndon’s bond was set at $30,000.

Stigall has an open case from his arrest in late April. Acting on information from law enforcement in Missouri, Fulton County authorities made a traffic stop on April 23 taking Stigall into custody. Missouri law enforcement had advised Stigall and a female had been found with a large amount of currency in their possession when they were stopped in a vehicle without a license plate. The two were also allegedly found with drug paraphernalia and a small amount of dabs or THC wax.

Stigall and his female passenger were stopped a second time by Fulton County authorities still traveling in a vehicle without a license plate.

Stigall told the officers the only reason he was driving was because his girlfriend had taken some medicine.

With Stigall on active supervision and a search waiver on file, officers located currency in the vehicle “different from the amount” reported by Missouri authorities. They also located drug paraphernalia with white residue.

When Stigall advised he had other illegal items on his person, officers retrieved a sandwich bag containing numerous baggies of a crystalline substance and a green vegetable material. The contents were field tested positive for methamphetamine and marijuana.

Stigall has been charged with two felony and two misdemeanor drug-related counts. His bond was set at $40,000.

Online court records indicate Stigall has been arrested three times since late 2016 on felony drug charges. In late 2018, he was sentenced to five years in the Arkansas Department of Correction on drug and firearm charges. Those charges stemmed from an incident in August 2018 when law enforcement responded to a call in the Sturkie area of an individual throwing rocks and cussing at citizens. Stigall and another man, both on probation/parole, were taken into custody.
