Fleeing suspect whose wrecked vehicle landed in pond arrested again

A man whose pickup truck wrecked and came to rest in a pond, after leading a high-speed pursuit from an Arkansas State Police trooper last month in Fulton County, has been arrested again.

According to the probable cause affidavit, 32-year-old Michael Kelly was arrested March 31 when he exited the Dollar General Store in Viola. Previous online court documents list Kelly’s address as Franklin.

In the latest case, Kelly was observed entering the store by Fulton County Chief Deputy Joe Boshears. The deputy was aware Kelly had active felony warrants and is a parolee on active supervision. He was also aware Kelly had fled from the trooper earlier in the month.

When Kelly exited the store, the deputy advised him he was under arrest. In response, Kelly reportedly said, “Joe, I’m not going to jail.” Kelly then proceeded to attempt to enter his vehicle.

Kelly allegedly continued to resist arrest while attempting to retrieve something numerous times from his right pocket.

After the suspect was placed in hand restraints, the officer located a small razor blade on the ground where the struggle occurred.

Assisting officers arrived to help with the search of Kelly’s vehicle and person, leading to the alleged discovery and drugs and paraphernalia.

Special agents with the 16th Judicial Drug Task Force conducted a TruNarc scan of the substances, with the results indicating one was a fentanyl and methamphetamine compound. A second substance tested negative for meth.

Kelly has been charged with

– possession with purpose to deliver a controlled substance, Schedule I, II, Class A felony;

– possession of drug paraphernalia, with the purpose to use fentanyl or heroin, Class D felony;

– fleeing on foot, Class C misdemeanor; and

– resisting arrest, Class A misdemeanor.

His bond is set at $300,000.

According to state and national crime information system databases, Kelly has four or more felony convictions and a suspended driver’s license.
