
A man is facing multiple charges after scuffling with a court bailiff during a court appearance. The incident that led to the arrest of 21-year-old Jabob William Gentry-Cape of Diamond City happened May 3 at the Marion County Courthouse Complex.
The probable cause statement from the Marion County Sheriff’s Office indicates a deputy was working as the court bailiff in district court when he observed Gentry-Cape, who was waiting to appear before the judge, had a knife in his back pocket and was told it would have to be left in his vehicle.
A short time later, the bailiff heard Gentry-Cape using profanity while inside the courthouse complex. The bailiff instructed Gentry-Cape to stop cursing but Gentry-Cape allegedly said, “I don’t speak your language,” and continued. The bailiff told Gentry-Cape to step outside, grasped his arm and moved out the door when Gentry-Cape began to resist and cursing at the bailiff. During the scuffle, the bailiff’s glasses, hearing aid, hat and radio were knocked askew.
During the struggle, the bailiff discovered Gentry-Cape still had two knives. The bailiff was able to get the knives and secure them. He then placed handcuffs on Gentry-Cape and had him sitting on the sidewalk when he noticed the man trying to step through his handcuffs and stand up. Gentry-Cape had stepped through with one leg and was in the process of stepping through with the second when the bailiff knocked him to the ground and held him until back up arrived.
Gentry-Cape is charged with a felony count of battery in the second degree for injuring a police officer in the line of duty; and three misdemeanor charges, including carrying a weapon in a state building, resisting arrest, and disorderly conduct. He is free after posting bonds totaling $22,615.
