A man arrested after firing several shots at his wife during a violent domestic disturbance at the couple’s residence in Norfork will plead to charges stemming from the incident later this month, according to an announcement made in Baxter County Circuit Court Thursday by his attorney, Mark Cooper.
Thirty-one-year-old Dale Wayne Davis is charged with aggravated assault, endangering the welfare of a minor and interfering with an emergency communications device.
Davis’ wife told investigators she returned home from work during the afternoon of June 20 last year and found her husband extremely intoxicated and in what she described as a “severe state of agitation.” She said she was upset with her husband for drinking to excess during a time he was responsible for caring for the couple’s small child.
The victim threatened to call law enforcement and Davis left the house. Davis’ wife reported she locked the front door hoping to keep him out, but he kicked another door open, reentered the residence and continued to threaten and argue in a loud voice.
The wife reported she contacted a third party to come to the residence and see if they could calm Davis down and perhaps talk him into leaving with the third party. The effort was unsuccessful.
The victim told Davis that she would not call law enforcement if he would “just get control of himself.”
He is reported to have taken her cellphone so she could not call anyone for help and retrieved a firearm from an adjacent closet near the front door. The wife said she tried to leave and go to a neighbor’s house. It was at this point in the incident that Davis began shooting. One round hit near the woman’s feet. She reported her husband then pointed the gun in her face and threw her phone on the ground.
She told law enforcement she bent down to pick the phone up and Davis is alleged to have fired a shot at her hand.
In all three shots were fired. As she made her way to the neighbor’s house, Davis is reported to have gotten in her vehicle and drove away from the scene.
He gave himself up at the Baxter County Detention Center five days after the incident. His bond was set at $50,000.
