Man who fought with officers and kicked state trooper in the leg pleads guilty

A man already in trouble for being intoxicated and then making things worse for himself by kicking an Arkansas State Police trooper, entered a guilty plea to a 2nd degree battery charge against during a session of Baxter County Circuit Court Monday.

He was sentenced to four years probation. Circuit Judge John Putman asked Deputy Prosecutor Kerry Chism if the trooper was in agreement with the proposed sentence. Chism said he was.

According to the probable cause affidavit, 59-year-old Peter Chiolero was described as “intoxicated and belligerent” when he arrived at the Baxter County Detention Center in the backseat of a Mountain Home policeman’s patrol unit.

A sheriff’s deputy and the Mountain Home officer got Chiolero out of the backseat of the Mountain Home Police Department unit and were escorting him to an entry door to the booking area at the jail.

The trooper who was in the process of leaving the detention center, remained in the area in case the other two law enforcement officers needed help controlling the unruly prisoner.

According to the probable cause affidavit, as Chiolero approached the location where the trooper was standing, he kicked the trooper in the leg.

Chiolero continued to fight and the trooper joined the other officers in trying to bring him under control. The trooper is reported to have gotten his left hand caught in Chiolero’s handcuffs causing an injury to the hand.

Chiolero was eventually brought under control and taken into the booking area of the jail.

The trooper was treated at Baxter Regional Medical Center.
