Marion County man accused of trying to kill family member

A Marion County man with a history of attempted murder and setting fire to a residence is now accused of trying to kill a family member. Thirty-nine-year-old Cody Wallace of Yellville is in the Marion County Law Enforcement Center facing a count of attempt to commit second-degree murder.

According to the probable cause affidavit, the Marion County Sheriff’s dispatch was notified April 7 of Wallace being in a physical domestic with the family member. She arrived at the sheriff’s office that evening with redness on her neck. The left side of her neck was also swollen. She alleged Wallace had just choked her and tried to kill her.

The family member stated Wallace called her that afternoon about her unloading items from her pickup truck and placing them in the shed on the family property on Arkansas Highway 125 North. She later arrived at the property to talk to Wallace, and he reportedly told her not to put anything else in his mother house because it was full. She responded by saying he has his own house, and hers is on the property.

Wallace reportedly became louder and angrier, and the family member said she wouldn’t argue about it any longer. Wallace allegedly attacked her and took her phone to prevent her from calling for help. The victim said she fell to the ground on her back, and Wallace was choking her with his hands around her neck from the front.

The family member said she was gasping and struggling to breathe, thinking she was going to die. Wallace reportedly said he “could end her, and she needed to grow up.” The victim’s daughter, who was still in the pickup truck, opened her door and told Wallace to stop hurting her mother. He reportedly loosened his grip and turned toward the daughter “as if he was going to hurt her.”

The victim stated she rolled over in an attempt to get to her daughter, but Wallace grabbed her by the hair and starting choking her from the back. He allegedly pulled her hair back, and her neck popped on the left side, causing a sharp pain to go up to the left side of her head. She claims Wallace pushed on her larynx with his thumb, causing her to choke on her saliva. The victim says she got lightheaded and nearly passed out.

Wallace is also charged with felony counts of aggravated assault on a family or household member and first-degree terroristic threatening and a misdemeanor count of first-degree interference with emergency communication. In addition, he faces a felony enhancement as a habitual offender.

In 2015, Wallace pled nolo contendere to a count of criminal attempt to commit first-degree murder. According to the probable cause affidavit, the male victim was asleep in a camper parked in the driveway of a residence on North Panther Avenue in Yellville during an early morning in October 2012. A person reportedly entered the camper and cut the victim’s throat. While being treated at Baxter Regional Medical Center, it was also discovered the victim had been stabbed once in the chest. He reportedly was in a relationship with a female who had previously been in another relationship with Wallace.

In December 2014, a jury convicted Wallace of arson and residential burglary. A special agent of the Arkansas State Police says a residence on Valley Street in Yellville was destroyed by an early morning fire in June 2013. The female occupant, with whom Wallace was reportedly attempting to have a relationship with, was not present at the time of the fire.

The Marion County jail log shows Wallace is being held without bond on a parole violation.
