Motion to suppress evidence filed in child porn case

A motion to suppress evidence in the case of a Mountain Home man charged with 30 counts of distributing, possessing or viewing child porn has been filed.

Twenty-four-year-old Stevie Lee Baker was arrested September 30 last year and is free on a $7,500 bond.

He has entered a not guilty plea to the charges against him.

He is being represented by the Public Defender’s office. Deputy Public Defender James Wallace told the court on Monday that the motion would be filed.

AFFIDAVIT IN CASE

According to the probable cause affidavit, an investigator discovered a number of images of children in sexually explicit poses when checking a cellphone that traced back to Baker.

Using GPS data, the investigator was able to tell that when certain sexually explicit images of children were viewed or saved to the cellphone, the activity was taking place in an area near Baker’s address in Mountain Home.

Investigators report that a number of items related to child pornography had been deleted from the histories of web searches done on the cellphone.

Because of the deletions, a charge of tampering with physical evidence was added to those related to the child porn images.

In the probable cause affidavit, the investigator writes that Baker allegedly “deleted his Internet history on his cellular device in an attempt to alter, destroy, suppress, remove and/or conceal the records of him viewing recordings of children engaging in sexually explicit conduct.”

The investigators reported checking on Internet searches made on the cell phone and finding one seeking information on, “can you clear the search history off an IPhone from an Android Phone.”

Other web searches dealt with the topic, “does a therapist have to report you if you have sexual urges about children?” and “child porn self-help.”
